ReUp Hemp Company Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of reuphempco.com and any purchase from ReUp Hemp Company (“ReUp,” “we,” “us,” or “our”). By accessing the website, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy, and any Return & Refund Policy posted on the website.

If you do not agree to these Terms, do not use the website or purchase our products.

1. Age and Eligibility

You must be at least 21 years old to access age-restricted portions of the website or purchase products from ReUp. By using the website or placing an order, you represent that:

  • You are at least 21 years old.
  • You are legally permitted to purchase, receive, possess, and use the products ordered.
  • The information you provide is truthful, current, and complete.
  • You are purchasing for yourself or another legally eligible adult and not for a minor.

We may require age or identity verification and may reject or cancel an order if verification cannot be completed.

2. Legal Availability and Customer Responsibility

Hemp and cannabinoid laws vary and may change without notice. Product legality can depend on federal, state, county, city, tribal, or other local law, as well as the product type, cannabinoid content, delivery method, and intended use.

ReUp ships products only to destinations where we determine the specific product may legally be sold, shipped, received, and possessed. We do not guarantee that a product is lawful in every jurisdiction or for every person. You are responsible for understanding and following the laws that apply to your location and circumstances.

We may restrict products, refuse service, hold an order for review, or cancel and refund an order when we believe fulfillment may violate a law, regulation, carrier requirement, payment-provider rule, or company policy.

3. Product Information and Certificates of Analysis

We make reasonable efforts to display product descriptions, ingredients, cannabinoid information, photographs, prices, availability, and laboratory results accurately. However:

  • Hemp is an agricultural product, and natural differences in color, aroma, appearance, moisture, weight, and cannabinoid content may occur.
  • Product images are for general illustration and may not show the exact batch received.
  • Certificates of Analysis (COAs) are batch-specific and should be reviewed before use.
  • Typographical errors, outdated information, or technical inaccuracies may occasionally occur.

We may correct information, change product specifications, or cancel an order affected by a material error. If we cancel a paid order, we will issue the appropriate refund.

4. Health and Safety Notice

ReUp products are not intended to diagnose, treat, cure, or prevent any disease. Statements on the website have not necessarily been evaluated by the U.S. Food and Drug Administration. Information provided by ReUp is for general informational purposes and is not medical advice.

Cannabinoid products may cause intoxication, drowsiness, dizziness, anxiety, changes in perception, or other effects. Individual responses vary. You agree to:

5. Orders and Acceptance

Submitting an order is an offer to purchase and does not guarantee acceptance. An automated order confirmation only acknowledges receipt of your order. We accept an order when it has been approved and processed for fulfillment.

We reserve the right to limit quantities or refuse, hold, or cancel any order, including orders involving:

  • Suspected fraud, resale, diversion, or unlawful activity.
  • Failed age, identity, payment, or address verification.
  • An ineligible shipping destination.
  • Product, pricing, inventory, or website errors.
  • A violation of these Terms or another ReUp policy.

If we cancel an order after payment has been captured, we will refund the applicable amount to the original payment method.

6. Pricing, Payments, and Taxes

Prices are listed in U.S. dollars unless stated otherwise and may change without notice. Taxes, shipping charges, service fees, and other applicable charges will be shown during checkout when required.

You authorize ReUp and its payment providers to charge the payment method submitted for the full order total. You represent that you are authorized to use that payment method. We may use third-party services to verify payment information, prevent fraud, and process transactions.

If a price or promotion is clearly incorrect, we may correct the error or cancel the affected order. Discounts and promotions may have separate conditions and may not be combined unless expressly allowed.

7. Shipping and Delivery

Shipping is governed by our Shipping Policy. Processing and delivery estimates are not guarantees. Weather, carrier delays, regulatory reviews, address problems, and circumstances outside our control may delay an order.

You are responsible for providing a complete and accurate shipping address and ensuring that an eligible adult can receive the package when required. Additional age verification, identification, delivery confirmation, or adult signature may be required.

To the extent permitted by law, ReUp is not responsible for delay, loss, return, or failed delivery caused by incorrect customer information, refusal of delivery, customer unavailability, theft after confirmed delivery, or a carrier event outside our reasonable control.

8. Returns, Refunds, and Cancellations

Return, refund, replacement, and cancellation eligibility is governed by the Return & Refund Policy posted on our website and applicable law. Contact us promptly if an order is incorrect, damaged, missing, or otherwise presents a problem.

Once an order has entered fulfillment or been transferred to a carrier, it may be impossible to modify or cancel it. Refunds, when approved, are generally issued to the original payment method. Processing times imposed by banks or payment providers are outside ReUp’s control.

9. Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity performed through your account. Notify us promptly if you believe your account or payment information has been compromised.

You may not impersonate another person, create an account using false information, or use another person’s account without permission. We may suspend or terminate accounts that present a security risk or violate these Terms.

If you submit a review, photograph, comment, or other content, you confirm that you have the right to provide it and that it is truthful, lawful, and does not violate another person’s rights. You grant ReUp a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content in connection with our business and marketing, subject to applicable law and our Privacy Policy.

We may remove user content that is unlawful, misleading, abusive, irrelevant, infringing, or otherwise inappropriate. We are not obligated to publish every submission.

13. Third-Party Services and Links

The website may use or link to third-party services, including payment processors, carriers, age-verification providers, social platforms, and external websites. ReUp does not control and is not responsible for the availability, content, security, or independent practices of third parties. Your use of a third-party service may be governed by that provider’s terms and policies.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” REUP DISCLAIMS IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT WHERE A WARRANTY CANNOT LEGALLY BE DISCLAIMED.

WE DO NOT GUARANTEE THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT EVERY PRODUCT WILL PRODUCE A PARTICULAR EFFECT, OR THAT PRODUCT INFORMATION WILL BE FREE FROM EVERY INACCURACY.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REUP AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE WEBSITE, AN ORDER, OR PRODUCT USE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REUP’S TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO REUP FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ReUp and its owners, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the website or products, your violation of these Terms, or your infringement of another person’s rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

Before filing a legal claim, you agree to contact us and make a good-faith effort to resolve the dispute informally. If the dispute cannot be resolved, the parties consent to the jurisdiction of the state and federal courts serving Buncombe County, North Carolina, unless applicable consumer law requires a different forum.

18. Changes to the Website or Terms

We may modify the website, products, policies, or these Terms at any time. Updated Terms will be posted with a revised effective date. Changes apply prospectively unless otherwise stated or required by law. Your continued use of the website after updated Terms become effective constitutes acceptance of those changes.

Provisions that by their nature should survive termination will remain effective.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies incorporated by reference constitute the entire agreement between you and ReUp concerning the website and purchases, except for any separate written agreement signed by ReUp.

You may not assign your rights or obligations under these Terms without our written consent. ReUp may assign these Terms as part of a merger, reorganization, sale, or transfer of its business or assets.
